By accessing or using this website (the “Site”) and/or placing an order with F3 Designs, LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the Site or place orders. We may update these Terms at any time by posting a new version on the Site. Your continued use of the Site after changes are posted means you accept the revised Terms.

We design and sell unique gift items and home décor products. Product descriptions, photos, sizes, and colors are for general information only and may vary slightly from the final product due to screen settings, materials, or the handmade nature of certain items.

For customized orders (for example, names, dates, messages, uploaded images or logos), you are responsible for:

• Ensuring all personalization details are correct at the time you place the order.
• Ensuring you have the legal right and any necessary permissions to use any text, logos, images, or other material you provide.

We may decline or cancel any customization request we consider inappropriate, offensive, illegal, or infringing on third‑party rights.

All orders placed through the Site are offers to purchase products under these Terms. We may accept or reject any order at our sole discretion.

You agree to:

• Provide accurate, current, and complete information during checkout.
• Pay all prices, taxes, shipping, customs duties, and other charges shown or applicable at checkout.

For custom items, payment in full is generally required before production begins. We reserve the right to change prices at any time, but changes will not affect orders we have already accepted.

If we provide digital proofs or mockups for customized products, you must review them carefully for spelling, dates, colors, and layout.

• Your approval of a proof is considered final.
• After approval, changes may not be possible or may require additional time and payment.

We are not responsible for errors, omissions, or design issues that were present in an approved proof.

Estimated production and shipping times are provided as guidelines only and are not guaranteed. Delays can occur due to order volume, material availability, carrier issues, customs processing, or events outside our control. Standard shipping is normally between 3-5 business days. 

Once an order is shipped:

• Risk of loss passes to you when we deliver the order to the shipping carrier.
• We are not responsible for carrier delays, loss, or damage, but we will make reasonable efforts to assist you in working with the carrier.

You are responsible for providing a complete and accurate shipping address. We are not responsible for orders shipped to an incorrect or incomplete address provided by you.

We ship worldwide. For orders shipped outside the United States:

• You are responsible for any customs duties, taxes, import fees, and other charges imposed by the destination country.
• Customs processing may cause additional delays beyond our control.
• You are responsible for ensuring that the products ordered may be lawfully imported into the destination country.

Because many of our products are custom‑made and personalized, they may not be eligible for return or exchange except where required by law.

Unless otherwise stated on the Site:

• Custom and personalized items are final sale, except where there is a defect or error caused by us.
• Non‑custom items may be returnable within a specified period if unused and in original condition, subject to any separate return policy posted on the Site. Customers are responsible for any and all return shipping charges. 

If you receive a defective, damaged, or incorrect item, you must contact us within 30 days of delivery with your order details and clear photos of the issue. After reviewing, we may, at our discretion, offer a replacement, repair, store credit, or refund.

Orders may only be canceled before production on custom items has begun. Once production has started, cancellations may not be possible or may incur a cancellation fee to cover work already performed and materials used.

All designs, product images, text, logos, graphics, and other content on the Site are owned by or licensed to F3 Designs, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or use our content without our prior written permission.

If you provide content (such as text, images, logos, or artwork) for customization:

• You represent and warrant that you own that content or have obtained all necessary rights and permissions to use it.
• You agree that your content does not infringe any third‑party rights or violate any laws.
• You grant us a non‑exclusive, worldwide, royalty‑free license to use, reproduce, modify, and display that content solely for the purpose of designing, producing, and delivering your order and, if you provide consent, for marketing and portfolio purposes.

You agree not to:

• Use the Site for any unlawful, fraudulent, or abusive purpose.
• Attempt to gain unauthorized access to the Site, other user accounts, or our systems.
• Interfere with or disrupt the operation or security of the Site or our services.

We may suspend or terminate your access to the Site, without notice, if we believe you are violating these Terms or any applicable law.

The Site and all products and services are provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. To the fullest extent permitted by Montana law and any other applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.

We do not warrant that the Site will be uninterrupted, secure, or error‑free, that defects will be corrected, or that any content is accurate, complete, or current.

To the fullest extent permitted by Montana law and any other applicable law, F3 Designs, LLC and its members, managers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or related to:

• Your use of or inability to use the Site.
• Any products or services purchased through the Site.
• Any conduct or content of any third party.

For any claim related to a specific order, our total liability to you will not exceed the amount you paid to us for that order.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless F3 Designs, LLC and its members, managers, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Site or products.
• Your breach of these Terms.
• Your violation of any law or the rights of any third party, including intellectual property rights.

These Terms and your use of the Site will be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict‑of‑laws principles.

Any legal action or proceeding arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in The United States of America, Montana, USA, and you consent to the personal jurisdiction and venue of such courts.

If you sell to consumers in other countries, you acknowledge that mandatory consumer protection laws in those countries may also apply.

Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you consent to our collection and use of your information as described in the Privacy Policy.
